Not sure what others think about our current set of HOA rules. After many years, I’ve read through our HOA rules and have a few opinions on what is good, bad and deficient. I am curious what others think of our rules. I would even be interested to do a little exercise and see how many people are for or against the rules I mention below. Ideally, it would be great to have people take a vote on the individual rules via the web, but perhaps a mention on this message board would be a good start. I think we might be surprised by the results.

1. Rule 1.5: Recreational Vehicles. We currently do not own a motor home, but it certainly would not bother me to see my neighbors park their motor home or travel trailer in their driveway. A number of people I know in our neighborhood rent storage for their motor home, which I would consider an unnecessary expense. In my opinion, this rule doesn’t make sense for our neighborhood. I would be interested to see what others think.

2. Barking Dogs. Personally, I love dogs, but I don’t like their barking, which I can hear inside my house coming from all over the neighborhood. I am not talking about the occasional bark at a squirrel. I am talking about a dog that walks through its doggy door to the outside while its owners are away and embarks (no pun intended) upon a half-hour serenade of woof, woof, woof… woof, woof, woof for no apparent reason at all (no neighbors walking by the house, no other animals in sight). Then the dog takes a little break and a short while later is at it again. It’s like the dog is venturing outside to sing to the neighborhood. This is totally unacceptable to me. Another example are dogs that are shoved unto the porch in the evening while its owners leave the house. The dogs bark till 3 a.m. in the morning keeping me and my kids up. This occurs week after week after week in the summers. Another unacceptable situation. I would rather see motor homes in our neighborhood than constantly put up with barking dogs. The rule on activity restrictions that spells out no disturbing activity of any kind is not being enforced by our HOA.

3. Trash cans to be pulled back within 24 hours. I think most people don’t have an issue with it, but it happens on occasion that people go away for a couple of days, starting on trash day, which happens to be Monday morning in our neighborhood. According to this rule, in order for them to comply with it, they need to arrange with someone to go out before Tuesday morning and retrieve their trash can from the street. I would rather see the rule state something to the affect: Neighbors should retrieve their trash can from the street the same day after pickup. I don’t have a problem with my neighbor’s trash can sitting at the curb for 48 hours on rare occasions and certainly do not agree with it being a rule that exposes the neighbors to a fine.

4. Commercial use of property. There are those that like to work out of their home office, such as web developers, book authors, etc. Yet, to me, the way this rule has been rephrased in the proposed new CC&Rs says you can’t do that. This makes absolutely no sense to me what-so-ever. It’s one thing to have a commercial business where clients come to your office on a regular basis and create additional traffic in the neighborhood, it’s quite another to have a home office for commercial purposes where you don’t have clients visiting your home. I find this rule unacceptable in its current form. Am I misunderstanding the rule?
